Home Information Pack Regs Published

Dear Richard
As you may be aware, the government published the Home Information Pack regulations yesterday.
As expected, there were no major surprises - the changes that have been made reflected the feedback from industry announced in January, with only a slight adjustment to the date when HIPs must be made available for properties already on the market on June 1st.
We are currently reviewing the regulations, but the most important points appear to be;

  • If a property is already on the market on June 1st, a HIP will only be needed if it still being marketed after 31st December 2007
  • Properties may be marketed with a limited set of documents, although
    evidence must be shown of an instruction to a company to find those that
    are missing
  • The order of the documents in the HIP has been set, and the Energy
    Performance Certificate must be the first one
  • The information in a HIP needs to be refreshed only when the property
    is taken off the market for over a year and then remarketed
  • For now, personal search companies can continue to insure against
    issues caused by their not being able to access certain data for their
    reports
